WisDOT policy
In response to the COVID-19 pandemic, WisDOT allowed temporary parklets by developing agreements with local municipalities solely for outdoor dining use. After careful consideration, WisDOT will not allow temporary or permanent parklets on state trunk highways or connecting highways. This is a proactive measure to create a safe system for all users of transportation facilities and the public right of way.
Parklets differ from incorporating a public area within a highway improvement project to allow a community to help enhance safety for general public activity. The department is open to working with municipalities during the project development process to identify opportunities that meet the needs of the community, provide a safe environment for all users, and create an efficient and maintainable transportation facility. Spaces created through this process require an agreement with the municipality and shall be open to the public, not business specific.
